By accessing or using the Services, submitting information through the Services, or otherwise interacting with us, you acknowledge that you have read, understood, and agree to be legally bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use the Services.

1. Eligibility

The Services are intended solely for individuals who:

Are residents of the United States;

Are at least eighteen (18) years old; and

Are legally capable of entering into binding contracts.

By using the Services, you represent and warrant that you satisfy all eligibility requirements.

2. Insurance Marketplace Disclosure

Filtered Quotes is a marketing and lead generation company. We are not an insurance carrier, insurance underwriter, or health plan administrator. Unless expressly stated otherwise, Filtered Quotes is not acting as your insurance agent, broker, fiduciary, or financial advisor.

The Services are designed to connect consumers seeking information regarding insurance products and services with licensed insurance agents, agencies, carriers, lead buyers, aggregators, marketing partners, and related service providers (“Marketing Partners”).

By submitting your information through the Services, you acknowledge and agree that:

You are requesting to be contacted regarding insurance-related products or services;

Filtered Quotes may share, sell, license, distribute, or otherwise transfer your information to Marketing Partners;

Marketing Partners may independently determine whether to contact you;

Filtered Quotes does not guarantee that you will receive insurance quotes, offers, coverage, savings, or eligibility determinations; and

Any insurance purchasing decision is solely between you and the applicable insurance provider or licensed agent.

Filtered Quotes does not endorse or recommend any particular insurance product, carrier, or agent.

3. User Representations

By using the Services, you represent, warrant, and agree that:

All information you provide is truthful, accurate, current, and complete;

You are the authorized user of any phone number or email address you submit;

You will not submit information on behalf of another person without authorization;

You will not use false identities, spoofed phone numbers, disposable email addresses, or misleading information;

You will not use automated systems, bots, scripts, or artificial methods to submit information through the Services;

You will not use the Services for fraudulent, unlawful, abusive, or unauthorized purposes; and

Your use of the Services complies with all applicable laws and regulations.

We reserve the right to reject, suspend, or terminate access to the Services at any time and for any reason.

4. Consent to Communications

By submitting your information through the Services, clicking a submission button, checking a consent box, or otherwise providing your prior express written consent, you agree that Filtered Quotes and its Marketing Partners may contact you regarding insurance-related products and services using:

Telephone calls;

Text messages (SMS/MMS);

Email communications;

Prerecorded or artificial voice messages; and

Automatic telephone dialing systems or other automated technology.

You understand and acknowledge that:

Your consent is not a condition of purchasing any goods or services;

Message and data rates may apply;

Message frequency may vary;

Consent applies even if your number appears on a federal, state, or internal Do Not Call list; and

You may revoke consent at any time through reasonable means, including replying STOP to text messages where applicable.

You further acknowledge that consent records, including but not limited to:

Timestamps,

IP addresses,

Session data,

Consent language versions,

TrustedForm certificates,

Jornaya LeadID records,

Call recordings, and

Related verification data

May be retained by Filtered Quotes and its service providers for compliance, evidentiary, operational, legal, and business purposes.

5. Electronic Signatures and Electronic Records

By using the Services, you consent to the use of electronic signatures, electronic disclosures, electronic records, and electronic contract formation.

You agree that:

Your electronic submissions constitute your legal signature;

Electronic records satisfy any legal requirement that communications be in writing; and

You have the ability to access and retain electronic records.

You may withdraw your consent to electronic communications by discontinuing use of the Services.

6. SMS Communications

If you opt into SMS communications, you agree to receive recurring text messages from Filtered Quotes and/or its Marketing Partners regarding insurance products, services, lead follow-up, customer support, marketing, and related communications.

Message frequency varies. Message and data rates may apply.

You may opt out at any time by replying STOP to a text message. For help, reply HELP or contact us using the information below.

Your participation in SMS programs is also subject to any separate SMS Terms & Conditions published by Filtered Quotes.

7. Call Recording and Monitoring

You acknowledge and agree that telephone calls involving Filtered Quotes or its Marketing Partners may be monitored and recorded for purposes including:

Quality assurance;

Compliance;

Training;

Fraud prevention;

Dispute resolution; and

Operational analysis.

By engaging in such communications, you consent to such recording and monitoring to the fullest extent permitted by applicable law.

8. Privacy

Your use of the Services is subject to our Privacy Policy, which is incorporated into these Terms by reference.

Filtered Quotes may collect, store, process, analyze, share, and transfer information as described in the Privacy Policy.

9. Intellectual Property

All content, trademarks, service marks, trade names, graphics, logos, software, text, designs, functionality, and materials comprising the Services are owned by or licensed to Filtered Quotes and are protected by intellectual property laws.

You may not:

Reproduce,

Distribute,

Modify,

Reverse engineer,

Scrape,

Frame,

Republish,

Exploit, or

Create derivative works

from the Services without prior written permission from Filtered Quotes.

10. Third-Party Services and Links

The Services may contain links to third-party websites, products, services, or advertisements.

Filtered Quotes does not control and is not responsible for:

Third-party content;

Third-party privacy practices;

Third-party communications;

Third-party offers; or

Any actions taken by Marketing Partners or other third parties.

Your interactions with third parties are solely between you and those third parties.

11. Disclaimer of Warranties

THE SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FILTERED QUOTES DISCLAIMS ALL WARRANTIES, INCLUDING:

Merchantability;

Fitness for a particular purpose;

Non-infringement;

Accuracy;

Completeness;

Availability; and

Reliability.

FILTERED QUOTES DOES NOT GUARANTEE:

That you will receive insurance quotes;

That you will obtain coverage;

That you will save money;

That marketing partners will contact you; or

That the services will operate without interruption or error.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FILTERED QUOTES AND ITS OFFICERS, MEMBERS, EMPLOYEES, CONTRACTORS, AFFILIATES, SERVICE PROVIDERS, AND PARTNERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES.

IN NO EVENT SHALL THE TOTAL LIABILITY OF FILTERED QUOTES EXCEED ONE HUNDRED DOLLARS ($100.00).

THIS LIMITATION APPLIES REGARDLESS OF THE THEORY OF LIABILITY.

13. Indemnification

You agree to defend, indemnify, and hold harmless Filtered Quotes and its affiliates, officers, employees, contractors, licensors, successors, and assigns from and against any claims, liabilities, damages, losses, judgments, costs, expenses, and attorneys’ fees arising out of or related to:

Your use of the Services;

Your violation of these Terms;

Your violation of applicable law;

Your submitted information; or

Your infringement of any rights of another party.

14. Arbitration Agreement

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.

Any dispute, claim, or controversy arising out of or relating to these Terms, the Services, communications received through the Services, or the relationship between you and Filtered Quotes (“Dispute”) shall be resolved exclusively through binding individual arbitration administered by the American Arbitration Association (“AAA”) pursuant to its applicable rules.

Arbitration shall:

Be conducted on an individual basis only;

Take place in Pinellas County, Florida, unless otherwise required by applicable law;

Be conducted before a single arbitrator; and

Be governed by the Federal Arbitration Act.

The arbitrator shall have exclusive authority to resolve any dispute relating to:

Interpretation,

Applicability,

Enforceability, or

Formation of this arbitration provision.

You and Filtered Quotes agree that any arbitration shall be limited solely to the Dispute between the parties individually.

Third Party Beneficiaries

USHEALTH Advisors, LLC and USHEALTH Group, Inc. and their affiliates and its independent insurance advisors are express and intended third party beneficiaries of this agreement to arbitrate and shall have the right to enforce it against you to the same extent as if they were a party to this agreement.

15. Class Action Waiver

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

You waive any right to participate in a class action;

You waive any right to participate in a class arbitration;

You waive any right to act as a private attorney general; and

You waive any right to consolidate claims with other persons.

ALL DISPUTES MUST BE BROUGHT SOLELY IN AN INDIVIDUAL CAPACITY.

16. Governing Law

These Terms and any Disputes shall be governed by the laws of the State of Florida, without regard to conflict of law principles.

17. Limitation Period

To the fullest extent permitted by law, any claim or cause of action relating to the Services or these Terms must be filed within one (1) year after the claim arose or be permanently barred.

18. Modifications to Terms

Filtered Quotes reserves the right to modify these Terms at any time in its sole discretion.

Updated Terms become effective immediately upon posting. Your continued use of the Services constitutes acceptance of the revised Terms.

19. Severability

If any provision of these Terms is found unenforceable, the remaining provisions shall remain in full force and effect.

20. Assignment

Filtered Quotes may assign or transfer these Terms and its rights and obligations without restriction.

You may not assign your rights or obligations under these Terms without prior written consent.
